Type-75 ABC License For Sale Buyer can Convert to a Type-47
OPPORTUNITY: Type-75 licenses are very popular as they allow for the sale of spirits (full liquor) in counties where full liquor licenses are quite expensive. The license holder must produce beer onsite.

Brewpub License Conversion: Effective January 1, 2023, SB 298 allows brewpub licensees who have held a Type 75 license since on or before December 31, 2019 to exchange their brewpub license for a Type 47 bona fide public eating place license. A license issued as an exchange would not be subject to the on-sale general license caps and may not be sold or transferred for a price greater than the fee paid by the seller or transferer. To hold a Type-75 license, the restaurant/brewpubs must have a minimum 7-barrel commercial brewing system located permanently onsite, that can produce at least 7 barrels of beer per brewing cycle. The license holder must produce at least 100 barrels of beer per year and no more than 5,000 barrels per year.
This license does not authorize the off-premises sale of alcoholic beverages for consumption.

Type-47 Exchange: (Restaurant) Authorizes the sale of beer, wine and distilled spirits for consumption on the licenses premises. Authorizes the sale of beer and wine for consumption off the licenses premises. Must operate and maintain the licensed premises as a bona fide eating place. Must maintain suitable kitchen facilities, and must make actual and substantial sales of meals for consumption on the premises. Minors are allowed on the premises.
Many municipalities will require a conditional use permit to operate with a Type-47 license.

- Offers from Buyers with a fully operational and permitted restaurant will be considered first.
- Offers from Buyers who plan to exchange the license and transfer it to a fully operational and permitted restaurant or offers from Buyers with permitted brewing equipment installed on the premises of a fully operational and permitted restaurant will be considered first
- Buyer pays broker commission
- Buyer pays for ABC license transfer and annual fees/expenses. Buyers who will exchange the license to Type-47 will pay the ABC fees and expenses for the exchange.
